The One-Stop Shop for Businesses was created, and is regulated by, the Legislative Decree of 31 March 1998 no. 112, (bringing into force the measure better known as the Bassanini Law) and with the subsequent Decree of the President of the Republic of 20 October 1998, no. 447.

Legislative Decree no. 112/98 delegates to local Councils the responsibility for the administrative functions involved in  setting up, expanding, closing, re-opening, locating and re-locating  businesses, and also for those concerning any internal building works carried out for business use.

In order to carry out these duties, the local Councils are required to set up a single structure that will guarantee its users access to all the information concerning their requests for authorisation and the relative administrative procedure, and also information on what steps are needed to complete the authorisation process.  The Council is also required to provide all the relevant information on the availability of sites for new businesses, and  the availability or otherwise of financial inducements at a European, national, regional or local level.

The management of the single structure can be the responsibility of a single authority, or can be carried out in association with other organisations.

The procedure for setting up the company can occur in either of two ways :

• through a simplified procedure involving the presentation of a single application at the One-Stop Shop (whose officers will be responsible for sending the documentation to each organisation involved in issuing judgements, authorisations, or permits, and also for recourse to the services Conference)
• through auto-certification (and thus through a mechanism of silent assent)

The regulations under which the One-Stop Shops operate are :

• L 241/90 – regulations concerning administrative procedures and rights to access. 
• L 127/97 – Urgent measures to reduce the amount of bureaucratic tasks and procedures for decision making and control.
• DLGS 112/98 – which conferred administrative tasks and responsibilities previously carried out by the State to the Regions and local authorities, implementing section I of L 59/97.
• DPR 447/98 – a regulation concerning the simplification of authorisation procedures for setting up companies 
• DPR 440/2000 – Measures providing for the full implementation of the legal provisions relative to the setting up of businesses.
